Single Use Plastic manufacturing units in the country
1347. SMT. VANDANACHAVAN:
Will the Minister of ENVIRONMENT, FOREST AND CLIMATE CHANGE be pleased to state:

(a) whether Government maintains a database of Single Use Plastic (SUP) manufacturing

units mandated to be registered with Central and State Pollution Control under Plastic

Waste Management Rules 2016, if so, State/UT/year/item-wise details thereof, and if

not, the reasons thereof;

(b) monitoring and punitive action taken against SUP manufacturing units not registered

with State/Central Pollution Control Board, the details thereof, and if not, the reasons

thereof;

(c) whether plastic packaging is included in SUP and if so, alternative solutions proposed

by Government and if not, the reasons therefor; and

(d) the reasons for non-inclusion of multilayered plastics in SUP framework?

ANSWER

(a): Registration under Plastic Waste Management (PWM) Rules, 2016, as amended,inter

alia is mandated for those units covered under the definition of producer or brand owner

under the Rules.As per rules, every producer or brand owner shall register with the concerned

State pollution Control Board or Pollution Control Committee of the Union Territory, if

operating in one or two states or union territories. In case, producer or brand owner, operates

in more than two states or union territories they shall register with Central Pollution Control

Board (CPCB). As per available information, 310 brand owners operating in more than two

states are registered under PWM Rules with CPCB.

(b): As per Rule 12 of the PWM Rules, 2016, 25 States/Union Territories (UTs) have

taken action against deviations reported under the Rules in their respective States/UTs

including action against unregistered units.

(c) & (d): As per Plastic Waste Management Amendment Rules, 2021, “Single-use

plastic commodity” mean a plastic item intended to be used once for thesame purpose before

being disposed of or recycled. As per the notification, the manufacture, import, stocking,

distribution, sale and use of following single-use plastic, including polystyrene and expanded

polystyrene, commodities shall be prohibited with effect from the 1st July, 2022:-

(i) ear buds with plastic sticks, plastic sticks for balloons, plastic flags, candy sticks, icecream sticks, polystyrene [Thermocol] for decoration;

(ii) plates, cups, glasses, cutlery such as forks, spoons, knives, straw, trays, wrapping or

packing films around sweet boxes, invitation cards, and cigarette packets, plastic or

PVC banners less than 100 micron, stirrers.

The Ministry of Environment, Forest and Climate Change has notified the draft Regulations

on the Extended Producer Responsibility for plastic packaging under Plastic Waste

Management Rules, 2016, as amended from time to time, in the Gazette of India vide GSR

No. 722 (E) on 6th October, 2021, for public consultation. Multilayered plastic packaging is a

separate category under the draft Regulations and is proposed to be covered under Extended

Producer Responsibility of Producer, Importer and Brand Owner.
