Solid Waste Management

Will the Minister of ENVIRONMENT,  FOREST AND CLIMATE CHANGE be pleased to state:

(a)whether the National Green Tribunal has instructed all the States and Union Territories to  

strictly implement the Solid Waste Management Rules, 2016;

(b)if so, the details thereof and the reaction of the State Governments thereto;

(c)whether the Government has taken steps to ensure that the said rules are being complied

with   properly in the States;

(d)if so, the details thereof; and

(e)the total number of complaints received so far since the implementation of the said rules  

particularly  from  Maharashtra  along  with  the  details  of  the  penalties  imposed  for

violation of the rules?

ANSWER

MINISTER OF STATE (INDEPENDENT CHARGE) FOR ENVIRONMENT, FOREST AND

CLIMATE CHANGE

(a) & (b)     The National Green Tribunal in its judgment dated 22.12.2016 in the Original

Application No. 199 of 2014 in the matter Almitra H. Patel versus Union of India has issued

direction in the interest of environment and public health that every state & union territories shall

enforce and implement the Solid Waste Management Rules, 2016 in all respect and without any

further delay.

(c) & d)     The Ministry of Environment, Forest and Climate Change has constituted under

the  Solid  Waste  Management  Rules,  2016,  the  Central  Monitoring  Committee  having

representatives from various Ministries. The first meeting of the Committee was held on 27

the January, 2017 to monitor the implementation of these rules.

(e)    Approximately 50 complaints have been received in the state of Maharashtra. The

Maharashtra Pollution Control Board regularly issues notices for this purpose to the Municipal

Corporations/Councils

. The Board has also issued directions under section 5 of EP Act, 1986 to

262 Local Bodies in the state of Maharashtra.
